The Detention Module

 

The Tribunal proposes to deal next with the issues arising out of the detention of various persons, 12 in number, arising out of the Garda investigations into the death of the Late Richard Barron. The Tribunal appreciates that hearing the entire detention module as a unit might cause unnecessary confusion. The Tribunal will therefore split the hearings up into 12 separate sub-modules. All relevant evidence in relation to the detention, or detentions, of each alleged suspect will be heard separately. Submissions will then be taken on the evidence. This accords with the practice of the courts. When a sub-module is finished, the Tribunal will move on to deal with the next sub-module until the procedure is completed. A separate sub-module will be heard last on the issue of the covert tape recording of suspects.

 

For reference to the issues identified by counsel as likely to arise in the Tribunal’s enquiries, parties are referred to the preliminary opening statement of counsel, which may be accessed on this web site. The section on arrest and detention of suspects refers.

 

The Tribunal is taking this step in ease of the parties. Each sub-module is estimated as being likely to last between only three and ten days. Interested parties, who have representation or who will be applying for representation, who wish to cross-examine witnesses or to make submissions, need only concern themselves for the relevant sub-module. Witnesses are, as is usual, only required for the time when they will be giving evidence. The Tribunal is mindful that this will minimise expense and inconvenience to those participating in the Tribunal’s work.

 

A schedule follows. It is probable that the hearings will take place between March and July of 2006. The witnesses listed are those proposed. Further witnesses may be added on application, as set out on this notice board. Interested parties are also listed as witnesses.  Note that where a detention is marked as occurring on a particular date, that is the date that the detention commenced; though it may have continued over other days.
